We built ARC for the long arc. That means being just as careful with your information as we are with what goes in the vessel. This policy explains what we collect, why, and the control you keep over it.
— 01 —Who we are
ARC ("ARC," "we," "us," or "our") operates this website and the ARC Nightly product and waitlist. For the purposes of applicable data protection law, ARC is the controller of the personal information described in this policy. If you have any questions, reach us at hello@arcnightly.com.
— 02 —What we collect
We only collect what we need to run the waitlist and, in time, fulfill orders. That includes:
- Information you give us. Your email address when you join the waitlist, and any details you provide when you contact us (for example, your name and the contents of your message).
- Order & fulfillment information. If and when you place an order, your name, shipping and billing address, and order history. Payment card details are handled by our payment processor — we never see or store full card numbers.
- Usage & device information. Basic technical data your browser sends automatically, such as IP address, browser type, referring page, and pages viewed, collected through cookies and similar technologies.

We use your information to:
- Add you to the waitlist and notify you about early access, launch, and availability.
- Process, ship, and support any orders you place.
- Respond to your questions and provide customer service.
- Send you updates about ARC — only when it matters, and only if you've opted in. You can unsubscribe at any time.
- Understand how the site is used so we can improve it, and keep it secure and functioning.
- Comply with our legal obligations.
We do not sell your personal information. We never have, and it isn't part of the plan.
— 04 —Legal basis (EEA/UK)
If you are in the European Economic Area or the United Kingdom, we process your personal data on the following bases: your consent (for marketing emails and non-essential cookies), the performance of a contract (to fulfill orders), our legitimate interests (to secure and improve the site), and legal obligation (where the law requires it).

We share personal information only with the service providers that help us operate, and only as needed:
- Email & marketing platforms to manage the waitlist and send updates.
- Payment processors to handle transactions securely.
- Shipping & fulfillment partners to deliver orders.
- Analytics & hosting providers to run and improve the site.
- Legal & safety — where required by law, or to protect the rights, property, or safety of ARC, our customers, or others.
These providers are bound to use your information only to perform services for us. If ARC is ever involved in a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction; we will notify you before it becomes subject to a different privacy policy.

We use a small number of cookies and similar technologies. Essential cookies keep the site working; optional analytics cookies help us understand usage. You can control cookies through your browser settings, and where required we'll ask for your consent before setting non-essential cookies. Blocking some cookies may affect how parts of the site function.
— 07 —Data retention
We keep personal information only as long as we need it for the purposes described here — for example, for as long as you remain on the waitlist or a customer, and afterward as needed to meet legal, tax, or accounting requirements. When we no longer need it, we delete or anonymize it.

Depending on where you live, you may have the right to:
- Access the personal information we hold about you.
- Correct information that is inaccurate or incomplete.
- Delete your personal information.
- Object to or restrict certain processing.
- Withdraw consent at any time (this won't affect processing done beforehand).
- Request a portable copy of your data.

California residents have additional rights under the CCPA/CPRA, including the right to know, delete, and opt out of "sales" or "sharing" — note that we do not sell or share personal information as those terms are defined.

We use reasonable technical and organizational measures to protect your information, including encryption in transit and access controls. No method of transmission or storage is perfectly secure, but we work to keep your data safe and to review our practices over time.

ARC is intended for adults. We do not knowingly collect personal information from anyone under 18. If you believe a minor has provided us information, contact us and we will delete it.

We may update this policy as ARC grows or as the law changes. When we do, we'll revise the "last updated" date above, and for material changes we'll provide a more prominent notice. Please check back periodically.
